मुंबई | नाशिक : नाशिक येथे २०२७ मध्ये होणाऱ्या सिंहस्थ कुंभमेळ्यासाठी साधुग्राम उभारण्याच्या नावाखाली तपोवन परिसरातील सुमारे १८०० झाडांची कत्तल करण्याच्या निर्णयावर मुंबई उच्च न्यायालयाने गुरुवारी महत्त्वपूर्ण हस्तक्षेप केला आहे. न्यायालयाने वृक्षतोडीविरोधात दाखल करण्यात आलेल्या जनहित याचिकेची दखल घेत सर्व प्रतिवादींना नोटीस बजावली असून, येत्या १४ जानेवारीपर्यंत कोणतीही वृक्षतोड न करण्याचे स्पष्ट आदेश दिले आहेत.

नाशिक येथील मधुकर जगताप यांनी वकील पायल वर्धन आणि ओमकार वाबळे यांच्यामार्फत ही जनहित याचिका दाखल केली आहे. या याचिकेवर गुरुवारी तातडीची सुनावणी झाली. सुनावणीदरम्यान, निर्णयावरील सूचना-हरकतींवर अद्याप अंतिम निर्णय झालेला नसल्याने सध्या वृक्षतोड करता येणार नसल्याची तोंडी माहिती राज्य सरकार व नाशिक महानगरपालिकेच्या वतीने न्यायालयास देण्यात आली. यानंतर, मुख्य न्यायमूर्तींच्या अध्यक्षतेखालील खंडपीठाने याचिकेतील सर्व प्रतिवादींना नोटीस बजावली व न्यायालयाच्या स्पष्ट परवानगीशिवाय कोणतीही वृक्षतोड केली जाणार नाही, असे निर्देश दिले. (Tapovan tree cutting High Court decision)

याचिकाकर्त्यांनी न्यायालयाकडे मागणी केली आहे की, याचिका प्रलंबित असताना १८०० झाडांची कत्तल थांबवावी, वृक्षतोडीच्या आदेशाला स्थगिती द्यावी तसेच साधुग्राम उभारणीसाठी पर्यायी जागा शोधण्याचे आदेश द्यावेत. ही याचिका बुधवारी सादर करण्यात आली होती आणि तातडीची सुनावणी आवश्यक असल्याचे नमूद केल्यानंतर न्यायालयाने गुरुवारी सुनावणी ठेवली.

नाशिक येथे दर १२ वर्षांनी सिंहस्थ कुंभमेळा भरतो. पुढील कुंभमेळा २०२७ मध्ये होणार असून त्यासाठी तपोवन परिसरात तात्पुरत्या स्वरूपात साधुग्राम उभारण्याचे नियोजन आहे. मात्र, यासाठी ३० ते ४० वर्षे जुनी झाडे तोडली जाणार असल्याने पर्यावरणप्रेमी व स्थानिक नागरिकांकडून तीव्र विरोध होत आहे, असा दावाही याचिकेत करण्यात आला आहे.

तपोवनातील वृक्ष हे नाशिक शहरासाठी ‘प्राणवायू’ असल्याचा दावा करत, विकासाच्या नावाखाली पर्यावरणाचा ऱ्हास केला जात असल्याचे याचिकाकर्त्यांनी नमूद केले आहे. वृक्षतोडीचा निर्णय हा पर्यावरण संरक्षणाच्या मूलभूत तत्त्वांचे उल्लंघन करणारा असल्याचे पटवून देण्यासाठी सर्वोच्च न्यायालयाच्या विविध निवाड्यांचा दाखलाही याचिकेत करण्यात आला आहे.

Mumbai | Nashik: The Bombay High Court on Thursday delivered a significant interim order regarding the proposed cutting of around 1,800 trees at Tapovan in Nashik for the construction of Sadhugram ahead of the 2027 Simhastha Kumbh Mela. Taking cognizance of a Public Interest Litigation (PIL), the court issued notices to all respondents and imposed a complete stay on tree cutting till January 14.

The PIL has been filed by Nashik resident Madhukar Jagatap through advocates Payal Vardhan and Omkar Wable. During the urgent hearing, the state government and Nashik Municipal Corporation informed the court that objections and suggestions related to the decision are yet to be finalized, and therefore tree cutting cannot be carried out at present. Following this submission, the division bench headed by the Chief Justice clarified that no tree cutting shall be permitted without the explicit permission of the court and issued notices to all respondents named in the petition. (Tapovan tree cutting High Court decision)

The petitioner has sought directions to restrain the authorities from cutting 1,800 trees while the petition is pending, to stay the existing tree-cutting order, and to direct the administration to identify an alternative site for setting up Sadhugram. The petition was filed on Wednesday, and considering the urgency, the court listed it for immediate hearing on Thursday.

Nashik hosts the Simhastha Kumbh Mela once every 12 years, with the next edition scheduled for 2027. For this event, Sadhugram is proposed to be set up temporarily at Tapovan. However, the plan involves cutting trees that are 30 to 40 years old, leading to strong opposition from environmentalists and local residents.

The petitioner has argued that the trees at Tapovan act as the ‘lungs’ of Nashik city and that indiscriminate development in the name of infrastructure is causing severe environmental degradation. The petition also cites several Supreme Court judgments to establish that the decision to cut trees violates fundamental principles of environmental protection.
